			<content:encoded><![CDATA[<p>Arizona is well known for it&#8217;s bustling capital city of Phoenix, a hot spot of cultural, natural and historical value. The whole state of Arizona has much to offer residents or visitors in the way of job opportunities, real estate and attractions. The economy is based around agricultural production in cattle, cotton, diary, lettuce and hay, while their industries focus on mining, electric and transportation equipment, machinery, printing and publishing, food processing, electronics and tourism. These markets are steady enough that job opportunities are all around, keeping the state a prime locale for new residents, which in turn helps stabilize the real estate market and home value averages.</p>
<p>Arizona is also home to one of the 7 Wonders of the World, the Grand Canyon, which is the biggest tourist draw in the state. Other attractions include bustling nightlife of the major cities of Phoenix, Tucson and Flagstaff (where visitors and locals alike partake in the myriad bars, billiards, casinos and music and comedy shows available) as well as the many museums and festivals dedicated to the cultural arts. With a large Native American population, Native ruins, historic and cultural sites are always a big draw, as are any sites having to do with the &#8220;Old West.&#8221; With so many different things to do, it&#8217;s no wonder Arizona has been one of the top recipients of new people moving in from another state.</p>
<p>Arizona is currently home to 6,166,318 people, with the unemployment rate for April at about 4%, just a bit of an increase from the historical low of 3.9% from the previous month (March 2007). As of 2004 the median household income was about $43,696, which has most likely increased to about $45,000 or so by the end of 2006. The median home value in Arizona is currently $306,877 for a home a little over 1700 square feet.</p>
<p>Most real estate professionals agree that Arizona&#8217;s market has definitely shifted to a buyer&#8217;s market and the huge inventory of houses for sale help keep the home value averages down. Even the median home value for the greater Phoenix is down somewhat from what it was this time last year. Until the inventory of homes levels out, home value averages are likely to stay down. If you&#8217;re looking to buy in Arizona, now is a great time to do it. </p>

Since there are not many people that have this type of license, it usually costs about $1,000 to $1,500 per month to hire someone to be your Responsible Individual. If you have the money to spend, this is a great state to originate in. You are required to register your corporation as a foreign corporation with the state. This is very tedious because you actually have to file with two different agencies. Any trade names also need to be filed with the Secretary of State. Both the Broker and Banker licenses require that you obtain a surety bond. The surety bond is needed to protect consumers and third parties from the mortgage companies non-payment. The surety bond is not an insurance policy so it is required to be paid back if used.</p>
<p>Arizona does require that you have a physical office in the state in order to obtain a mortgage license, however, the responsible individual usually has a physical location in Arizona that may be used as your physical location. This location may be the physical location for an unlimited number of companies. The responsible individual as mentioned above is the biggest scam. I don&#8217;t fault the responsible individuals for this, but the state. The responsible individual will usually review some of your files on subject properties in Arizona just to cover them in case you are audited, however, the limited number of responsible individuals in the state makes it very costly to hire someone because they can charge a lot for their services The license application is fairly extensive and requires personal and company financials. There are numerous pages of information on the owners, officers, and directors of the company that must be completed. </p>

			<content:encoded><![CDATA[<p>Foreclosure is a general term that describes the legal process that a mortgage company uses to obtain ownership of a piece of real estate where it holds a security interest in that real estate. In Arizona, the legislature has enacted statutes that make this a non-judicial process in most cases, meaning the lender does not need to file anything with the court to complete the foreclosure. This streamlines the process when compared to other states like Florida where each foreclosure requires a separate lawsuit and involves the procedural complexities that invariably accompany lawsuits. Provided the mortgage company complies with the procedural requirements as set forth in the Arizona Revised Statutes, the completion of the foreclosure process, wherein a Trustee&#8217;s Sale is held and title transferred to the successful bidder, will terminate the homeowner&#8217;s ownership interest and entitle the purchaser to evict the previous homeowner if he or she has not vacated the property.</p>
<p>Although the lender can usually start the foreclosure process as soon as a homeowner is late with a single mortgage payment, most lenders will make numerous demands and try to work out some other solution before initiating the formal foreclosure process. While its impossible to predict how long a lender might take before taking this step, it is not unusual &#8211; particularly during these trying economic times &#8211; to see homeowners 3-6 months past due before a lender begins foreclosure proceedings. Significantly, as long as the homeowner is past due it is up to the lender to decide when it is going to proceed, and in some instances the lender may decide to wait many months or even years before foreclosing.</p>
<p>Most homeowners in Arizona have a deed of trust as opposed to a traditional mortgage, which allows the lender to foreclose without going to court. Arizona does, however, still have a mechanism whereby a foreclosure may be pursued judicially in the rare instance there is not a deed of trust or if the lender simply chooses to proceed judicially in lieu of foreclosing on the deed of trust. In some cases the lender may realize a financial advantage by going to court, so homeowners who are served with a lawsuit instead of a Notice of Trustee&#8217;s Sale should consult with an attorney as soon as possible.</p>
<p>To effect a non-judicial foreclosure in Arizona, the lender must appoint a Trustee, who is the person or entity that is legally entitled to sell the property in a Trustee&#8217;s Sale. The Trustee&#8217;s first action is to record a Notice of Trustee&#8217;s Sale in the county recorder&#8217;s office, which is a legal notice identifying the precise time and date, as well as the location, when the home will be sold. Arizona law requires that the Notice of Trustee&#8217;s Sale must be recorded at least 90 days before the sale date. The Notice of Trustee&#8217;s Sale must also be published in an appropriate newspaper and copies must be delivered to the homeowner and other interested parties.</p>

The new law will require police officers to question people if there is reason to believe they are in the country illegally. Currently, Civil rights groups are challenging the new law in court, arguing that it allows police to use racial profiling to go after suspected illegal immigrants. At the same time, others groups support the law as an effort to reduce the impact of illegal immigration in America. The passions on both sides are running high.</p>
<p>Supporters of the law point out that the federal government has been ineffective in stemming the tide of immigrants entering the country. There are an estimated 460,000 undocumented aliens residing in Arizona. The fear is that these undocumented aliens have a negative affect on American jobs and wages. At the same time, while acknowledging that illegal immigration is an issue, civil rights groups are concerned that the tough new law is not the proper way to solve the problem. The great fear is that police officers will target Hispanics solely on their race. Many worry that citizens of Hispanic decent will get caught up in the wide net of racial profiling.</p>
<p>Supporters of the law point out that the law only codifies current practices of the Arizona police force: As a general rule, if a person is arrested for a crime, their immigration status is checked by immigration authorities and they are flagged for deportation if they are undocumented. However, many wonder why there would be a need for the passage of a new law if it has no affect on current practices. There is also the fear that the law will act for a shield for bad cops to engage in racist practices. In the back of the minds of many, the question remains, with the passage of this law are we one step removed from requiring Hispanics to wear a patch on their clothing to indicate whether they are lawfully in the country.</p>

Electrical malfunctions, explosive accidents, sabotage, smoking and forgotten candles are just a few causes of serious fires. It therefore comes as no surprise that steel structures have grown highly popular in Arizona. The content of a steel building, e.g. furniture, carpets and drapes, can naturally still catch fire, but a fire-proof steel structure can prevent the fire from spreading to nearby rooms and buildings. With a steel structure, it is much easier to keep a fire under control until the fire fighters arrive. A fire that breaks out in a garage where a lot of gasoline filled equipment is found will for instance be much easier to contain if the garage is a durable steel building instead of a building constructed from less fire-proof materials. A metal building can be the difference between an awful, but manageable fire, and a fire that spreads to the main residence and causes severe injury or even fatalities.</p>
<p>A steel building is also an excellent way of getting peace of mind from malicious pets, such as bees and termites. In Arizona, you can for instance find the dreaded valley carpenter bee. These bees live in the valley and lower foothills of Arizona and nearby California and can cause severe destruction on wooden buildings. The valley carpenter bee will chew dead wood in order to create a nest inside wooden parts of a structure. To make it even worse, woodpeckers love to eat bees and will peck the wood apart to get to the nest. The combination of valley carpenter bees and hungry woodpeckers can naturally be disastrous, and opting for a steel building is therefore an excellent decision in Arizona and California.</p>

This is true whether or not the parties write out the terms and/or sign a written document. This is not the case when the contract concerns the sale of real property. There, the Statute of Frauds as codified in Arizona (ARS 44-101(6)) demands that contracts for the sale of real property be written and signed in order to be enforceable.</p>
<p>It is important to note, however, that the Arizona courts have consistently held that only the signature of the &#8220;party to be charged&#8221; is required. In other words, the contract must be signed by the party against whom enforcement is sought but does not necessarily have to be signed by the charging party. For example, a seller of real estate who never signed the sales contract may successfully maintain an action against a buyer who did sign the contract.</p>
